Selling a Loved One’s Car in Sydney: A Practical Guide for Executors and Families
When someone close to you passes away, their car is rarely the first thing on your mind. But sooner or later it needs attention. The car might be parked in a Parramatta driveway, or sitting in a retirement village car park in the Hills District.
The registration still needs to be dealt with, and many families simply don’t know where to start.
This Guide Help You to Handle it Without Stress
Step 1: Let Transport for NSW Know
The NSW Registry of Births, Deaths and Marriages usually notifies Transport for NSW of a death, but this can take time. If the death isn’t yet on record, you can provide a death certificate, a newspaper death notice, a letter from a solicitor or the NSW Trustee and Guardian, or a completed Advice of Death form.
Step 2: Decide Who the Car Goes To
The registration must be either transferred or cancelled. Under NSW rules, it can be transferred to the executor or administrator of the estate, a beneficiary, a surviving joint registered operator, the next of kin, or a buyer.
If the car is going to the executor, you’ll need the will, probate or letters of administration (original or certified copy). Written advice from a solicitor or the NSW Trustee & Guardian can also be accepted. Transfers to an executor or beneficiary don’t attract a transfer fee or stamp duty.
The full requirements are on the NSW Government’s deceased estates and vehicle registration page.
Step 3: Keep It or Sell It?
Many families decide to sell, especially when the car is older, needs repairs, or nobody in the family needs it. A private sale means advertising, fielding calls and letting strangers inspect the car, which can be hard to face during a difficult time. Selling to a car buyer is usually simpler. The estate gets a fair price, and the car is collected without anyone needing to drive it.
Step 4: Don’t Forget the Loose Ends
Before the car leaves, check:
- Toll accounts: Remove the plate from any Linkt or E-Toll account, or arrange to close the account.
- Personal items: Check the glovebox, boot and under the seats. Sunglasses, garage remotes and paperwork are often left behind.
- Insurance: Contact the insurer once the car has been sold or transferred.
